MUMBAI: This New Year's Eve, you can swing but you can't dance. To live music beyond 1.30 am that is at hotels, bars and restaurants across Mumbai. The Bombay high court on Friday refused to let 'orchestras' play on till 5am even though liquor can flow freely till then in restaurants. Over 200 Mumbai restaurants will have to switch to recorded music, a lawyer for an association of hotel owners said.
A vacation bench of the HC rejected a petition filed by the Indian Hotel & Restaurant Association (AHAR) for permission to play live music till 5am on January 1, 2012. The judges said any decision on timings for restaurants was "in the state government's realm".
"We cannot pass any directions," said Justices M L Tahaliyani and G S Godbole. They said that granting such permission would "amount to usurping the state's power" especially when a December 20 home department circular is "very clear and grants no such permission for orchestras".
